restent en détention





 

Le Mouvement Lao pour les Droits de l’Homme ( MLDH) exprime son extrême inquiétude au sujet de la détention arbitraire prolongée de quatre membres du Mouvement Etudiant du 26 octobre 1999, un groupe qui avait tenté d'organiser une manifestation pacifique à Vientiane afin de réclamer une justice sociale, le respect des droits humains et des réformes démocratiques.

Douze ans après leur arrestation, MM. Thongpaseuth Keuakoun , Seng-Aloun Phengphanh , Bouavanh Chanmanivong et Kèochay sont toujours incarcérés dans la prison de Samkhé dans la province de Vientiane, tandis que M. Khamphouvieng Sisa-At était décédé en prison fin 2001 suite aux tortures.


Le MLDH reste d’autant plus préoccupé que, lors de l'adoption finale de l'Examen Périodique Universel (EPU) de la République Démocratique Populaire Lao (RDPL) à l'ONU en septembre 2010, la RDPL avait totalement ignoré la recommandation de libérer '' les personnes détenues pour avoir participé à des manifestations pacifiques, notamment les leaders du Mouvement du 26 octobre 1999' ' et avait rejeté la ''' recommandation primordiale portant sur la création d'une commission nationale indépendante des droits de l'Homme en conformité avec les Principes de Paris ''.



Selon l'article 5 du Pacte International sur les Droits Civils et Politiques (PIDCP) que la RDPL a ratifié en septembre 2009, les prisonniers doivent être traités dans le respect des standards internationaux relatifs aux droits de l'Homme. L'arrestation de ces manifestants pacifiques, ainsi que la mort de l'un d'entre eux en détention montrent clairement l'échec du gouvernement lao en matière d'application des obligations dérivées des instruments internationaux de protection qu'il a ratifiés.



Le MLDH renouvelle son appel pressant à la communauté internationale --notamment l'Union Européenne et ses Etats membres, les Nations Unies, les Etats-Unis, au Japon, à l'Australie et l'ASEAN -- afin que des actions urgentes, concrètes et concertées soient prises pour que le gouvernement de la RDP Lao applique le Pacte International sur les Droits Civils et Politiques (PIDCP), ainsi que ses autres engagements internationaux liés à la déclaration des Nations Unies sur les défenseurs des droits de l'Homme de 1998 en tant qu'Etat Membre des Nations Unies, en procédant à la libération immédiate et inconditionnelle de MM. Thongpaseuth Keuakoun, Seng-Aloun Phengphanh, Bouavanh Chanmanivong et Kèochay, ainsi les personnes arrêtées le 2 novembre 2009 - Mme Kingkèo (39 ans), MM. Soubinh (35 ans), Souane (50 ans), Sinpasong (43 ans) et Khamsone (36 ans) arrêtés à Phon Hong, M. Nou (54 ans) arrêté à Pakkading, Mlle Somchit (29 ans), MM. Somkhit (28 ans) et Sourigna (26 ans), arrêtés à Vientiane – alors qu'elles se dirigeaient à Vientiane pour réclamer justice sociale et leurs droits fondamentaux.

4380 days after their arrest,

the four human rights defenders

of the Student Movement of 26 October 1999 remain in detention





 

The Lao Movement for Human Rights expresses its extreme concern about the prolonged arbitrary detention of four members of the Student Movement of 26 October 1999, a group that tried to organize a peaceful march in Vientiane to claim for social justice, human rights respect and democratic reforms.
Twelve years after their arrest, MM. Thongpaseuth Keuakoun, Seng-Aloun Phengphanh, Bouavanh Chanmanivong Keochay are still jailed in the prison of Samkhe, province of Vientiane, whereas Mr. Sisa-At Khamphouvieng died in prison from torture in 2001.


The Lao Movement for Human Rights is as highly worried by their plight as during the final adoption of the Universal Periodic Review (UPR) of Laos at the UN in September 2010, the LPDR had totally ignored the recommendation ''to release those detained for participating in peaceful demonstrations, including the leaders of the Movement of 26 October 1999 '' and rejected the'''primary recommendation for the creation of an independent national commission on human rights in accordance with the Paris Principles''.

In accordance with Article 5 of the International Covenant on Civil and Political Rights (ICCPR) ratified by the Lao People’s Democratic Republic in September 2009, the prisoners must be treated in compliance with international human rights standards. The arrest of peaceful protesters, and the death of one of them in dfetention show the failure of the Lao government in the implementation of the international human rights instruments it has ratified.


The Lao Movement for Human Rights urges to the international community - including the European Union and its Member States, the United Nations, the United States, Japan, Australia and ASEAN - to take urgent, concrete and concerted actions so that the Lao government applies the International Covenant on Civil and Political Rights (ICCPR), as well as other international agreements related to the United Nations declaration of 1988 on human rights defenders and proceed to the immediate and unconditional release of MM. Thongpaseuth Keuakoun, Seng-Aloun Phengphanh, Bouavanh Chanmanivong and Keochay and also those arrested on 2 November 2009 - Ms. Kingkèo (39), MM. Soubinh (35), Souane (50), Sinpasong (43) and Khamsone (36) arrested in Phon Hong, M. Nou (54) arrested in Pakkading, Miss Somchit (29), MM. Somkhit (28 years) and Sourigna (26), arrested in Vientiane - while they were heading to Vientiane to claim for social justice and basic human rights.
